1. The HomeShark Service

HomeShark provides a free online home energy audit tool that analyzes publicly available property data, satellite imagery, solar potential data, and optional utility bill information to generate an estimated home energy efficiency report ("Audit Report"). HomeShark also facilitates connections between homeowners and home improvement service providers through a lead referral program.

HomeShark is a technology platform and lead generator. We are not a licensed contractor, energy auditor, financial advisor, tax advisor, or legal advisor. Nothing on HomeShark constitutes professional energy, financial, tax, or legal advice.

The service is free to homeowners. HomeShark earns revenue by receiving referral fees from home improvement companies when homeowners request quotes and are connected with those providers.

2. Eligibility

You must be at least 18 years of age to use HomeShark. By using the service, you represent that you are 18 or older. You must be a resident of the United States. HomeShark is intended for use by homeowners or authorized representatives of the property being audited.

3. Estimates and Disclaimers — Important

All savings figures, efficiency scores, energy usage estimates, neighbor comparisons, and financial projections generated by HomeShark are estimates only. They are not guarantees of actual savings, costs, or outcomes.

HomeShark's Audit Reports are generated using:

Actual energy savings, costs, and payback periods depend on many factors including but not limited to: your home's actual construction and insulation quality, your specific utility rate plan, your household energy behavior, equipment installation quality, local climate variations, and future energy price changes. HomeShark does not warrant that any estimates will be achieved.

You should obtain professional assessments from licensed contractors before making any home improvement decisions.

4. Tax Credit and Rebate Disclaimers

HomeShark provides information about federal tax credits (including those available under the Inflation Reduction Act) and state and local rebate programs as a general educational resource. This information is not tax advice.

Consult a licensed tax professional or CPA before making financial decisions based on tax credit availability. HomeShark is not responsible for any tax, financial, or other outcome resulting from reliance on information provided in Audit Reports.

5. Solar Savings Disclaimers

Solar energy savings estimates shown in HomeShark Audit Reports are based on Google Solar API data, current local utility rates, and standard system performance assumptions. Actual solar savings vary significantly based on:

Statements like "save $X per year" or "system pays for itself in Y years" are estimates based on modeled assumptions, not guarantees. The 30% federal Investment Tax Credit (ITC) shown requires tax liability sufficient to use the credit and may be subject to phase-down or elimination by future legislation.

HomeShark complies with FTC Green Guides and does not make unsubstantiated environmental claims. All solar savings representations are based on calculations using publicly documented data sources. HomeShark's Savings Methodology document describes these calculations in detail.

6. Installer Quote Requests

When you request installer quotes, HomeShark shares your contact information with up to 3 home improvement service providers in the relevant category. By requesting quotes, you agree and understand that:

HomeShark makes reasonable efforts to vet providers for licensing and insurance status but cannot guarantee the accuracy or currency of this information. Provider networks and availability change over time.

7. TCPA Consent and Communications

By submitting a quote request and checking the consent box, you expressly consent to receive autodialed or prerecorded calls, text messages, and emails from HomeShark and from each of the home improvement service providers to whom your information is referred, at the phone number and email address you provide, for the purpose of discussing home improvement products and services. This consent is not a condition of purchase. Standard message and data rates may apply.

You may opt out of communications from HomeShark at any time by emailing privacy@homeshark.ai. To opt out of communications from a specific referred provider, contact that provider directly using the contact information provided in your confirmation email.

9. Intellectual Property

HomeShark and its content, features, and functionality — including the audit algorithms, report format, brand assets, and software — are owned by HomeShark and protected by copyright, trademark, and other intellectual property laws. You may use HomeShark for personal, non-commercial purposes only.

Your Audit Report is generated for your personal use. You may share it with contractors for the purpose of obtaining quotes but may not resell, republish, or use it for commercial purposes.

10. Disclaimer of Warranties

HOMESHARK IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT ON THE SERVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOMESHARK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST SAVINGS, LOST DATA, OR COSTS OF SUBSTITUTE SERVICES — ARISING FROM YOUR USE OF THE SERVICE, EVEN IF HOMESHARK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL HOMESHARK'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE EXCEED ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless HomeShark and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) information you submit to HomeShark.

13. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of HomeShark that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Los Angeles, California, and judgment on the award may be entered in any court having jurisdiction.

Class Action Waiver: You agree to resolve any dispute with HomeShark on an individual basis only. You waive any right to bring or participate in a class action lawsuit, class-wide arbitration, or any other representative proceeding against HomeShark.

Either party may seek emergency injunctive relief in a court of competent jurisdiction for claims involving intellectual property or unauthorized access to the service.

To initiate a dispute, email legal@homeshark.ai with a description of the dispute and your desired resolution. We will attempt to resolve the matter within 30 days before either party may initiate arbitration.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws principles. For claims not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

15. Changes to These Terms

We may modify these Terms at any time. We will provide at least 30 days' notice before material changes take effect by posting the updated Terms on this page with a new effective date and, where feasible, notifying you by email. Your continued use of HomeShark after changes take effect constitutes your acceptance.
